EB-5
Employment-based green card pathway for investors who commit qualifying capital to a U.S. business that creates at least 10 full-time American jobs.
Individual investors, founders, and their families who can commit $800,000 or $1,050,000 of lawfully sourced capital to a qualifying U.S. commercial enterprise. No employer sponsorship, job offer, degree, or language requirement applies.
Overview
The EB-5 Immigrant Investor Program provides a pathway to permanent residence for foreign nationals who invest $1,050,000, or $800,000 in a targeted employment area or qualifying infrastructure project, in a new U.S. commercial enterprise that creates at least 10 full-time jobs for U.S. workers. Investors participate either through a USCIS-designated regional center or as a direct investor in a business they own and run, and a spouse and unmarried children under 21 are included in the same case.
Alma handles the immigration case. Project selection, securities, corporate structuring, and tax matters sit with your own advisors.

Yes
- Capital investment: $1,050,000 in a new commercial enterprise, or $800,000 if the project sits in a targeted employment area (rural or high unemployment) or qualifies as an infrastructure project. The enterprise must have been established after Nov. 29, 1990, or restructured or expanded so that a new commercial enterprise results.
- Lawful source of funds: The capital must come from a lawful source, with a complete and traceable path of funds.
- At-risk investment: The capital must remain at risk and sustained for at least two years, with no guaranteed return.
- Job creation: The enterprise must create at least 10 full-time jobs for qualifying U.S. workers, where full-time means a minimum of 35 working hours per week. Job preservation applies only to a troubled business.
- Management role: The investor must participate in daily operations or policy formation. A limited partner role satisfies this for regional center investments.
- No sponsorship required: There is no employer, job offer, degree, language, age, or prior business experience requirement.
- Regional Center Investment (Form I-526E): Invest alongside other EB-5 participants in a project owned and operated by a third party. The enterprise can create the required jobs directly or indirectly, and up to 90% of the job creation requirement may be met with indirect jobs. These filings are eligible for the reserved set-aside categories: rural (20% of annual EB-5 visas), high unemployment (10%), and infrastructure (2%).
- Standalone or Direct Investment (Form I-526): Invest in a business you own and operate yourself. The enterprise or its wholly owned subsidiaries must itself employ the 10 qualifying workers, since indirect jobs do not count outside a regional center, and the category does not depend on regional center reauthorization.
