The H-1B classification allows U.S. employers to petition for nonimmigrant workers to perform services in specialty occupations requiring theoretical or technical expertise.

Yes (after an approved I-140 petition)
- Have a job offer from a U.S. employer for a role that requires specialized knowledge and a bachelor’s degree or higher in a related field.
- Possess at least a bachelor’s degree or its equivalent in a field directly related to the specialty occupation.
- Be paid the required prevailing wage for the geographic area and occupation type, as determined by the Department of Labor’s Wage and Hour Division.
- Have the employer complete a Labor Condition Application (LCA) that attest to compliance with minimum labor conditions, including wages and working conditions.
- Applicants must register for the H-1B lottery during the designated period in March. This applies to both regular cap applicants (65,000 visas) and advanced degree cap applicants (20,000 visas for U.S. master’s or higher degree holders). Cap-exempt applicants, such as certain nonprofit organizations, research institutions, or universities, do not need to enter the lottery and can file their petitions directly.
- USCIS conducts the lottery to randomly select applicants. Only those selected in the lottery can proceed to file their H-1B petition.
