The EB-2 National Interest Waiver (NIW) allows professionals with advanced degrees or exceptional ability to self-petition for permanent residence without employer sponsorship if their proposed endeavor has substantial merit, national importance, and the applicant is well positioned to advance it.

- Possession of an advanced degree (master’s or higher, or a bachelor’s degree plus at least five years of progressive experience) or demonstrated exceptional ability in the sciences, arts, or business.
- The proposed endeavor has substantial merit and national importance.
- Substantial merit can be shown through initiatives that create jobs, drive innovation, improve healthcare or education, advance scientific or technological research, strengthen cultural or artistic institutions, or address social or environmental challenges in the United States.
- National importance means the work has broad potential impact or significance beyond the local level.
- The applicant is well positioned to advance the proposed endeavor.
- Evidence may include education, skills, record of success, or relevant plans and resources.
- On balance, it would benefit the United States to waive the job-offer and labor-certification requirements.
- USCIS considers factors such as the importance or urgency of the endeavor, potential for job creation, and contributions to U.S. competitiveness and national interests.
USCIS conducts a final merits determination to assess whether, in the totality of the evidence, the individual’s qualifications and proposed endeavor justify granting the waiver in the national interest.
