Overview
The EB-2 PERM category provides a path to U.S. permanent residence for highly qualified professionals and individuals with exceptional ability in business, science, or the arts.
Most EB-2 cases require a PERM Labor Certification from the U.S. Department of Labor (DOL) to confirm that no qualified U.S. workers are available for the position.
Once the PERM is certified, the employer files Form I-140 with USCIS. After the priority date becomes current under the Visa Bulletin, the applicant can complete the process through Form I-485 (Adjustment of Status) or Consular Processing (DS-260).
